Award Upheld for Trucker Fired for Refusing Overweight Loads

Supreme Forest Products Inc. failed to shake a jury award of more than $260,000 to a man fired for refusing to drive trucks loaded beyond the federal weight limit. The jury’s award of punitive damages was reasonable, the U.S. Court of Appeals for the Second Circuit said in an unpublished opinion Feb. 6. There was enough evidence for the jury to find that the company acted recklessly with regard to driver Michael Kennedy’s rights, the court said.
