trailer damaged from probe

Jun 30, 2015 at 11:04 AM CST
I've gotten some nasty dents, gouges, and bent bow from being probed at cargill in Hutchinson. They say I can't prove it happened by them. Any suggestions or recourse?

I've always had good luck with Perdue paying for bows or straps. Did you send them a bill?

Our local elevator polked a hole in the bottom of a hopper

I was in Arkansas City on the east side. They work real hard at trying to bent bows. Watch them. She will do it on the up swing. The probe will get hooked and you will unhook it. Take a picture then.

I'm not sure you have much recourse without hard proof that they were responsible. You can know for a fact that they did it, but proving it is another story. I suspect enough time has passed by now (basically as soon as you leave their property) that filing an incident claim with the manager is probably not an option. I had this happen several years ago when I was driving for a company, but it was a local elevator and they took full responsibility right away so my boss was covered. These bigger outfits will do damn near anything to get out of paying for their fuck-ups though!

As I'm thinking about this, I came up with one possible remedy, though it's probably a long shot: Assuming you've already told Cargill what happened, I would get over to your local dealer or whomever does repairs on trailer slopes and get a quote for repairing the damage. I would then send them pictures of the damage, the time it happened and if possible the elevator ticket #, and a copy of the repair quote. There's still no "proof" that they did it, but it shows that you've documented the incident and are not just looking for a quick buck.

that's about the only thing i can think of once they claim they didn't do it. Good luck with this- keep us posted!

I have a brand new Wilson that got poked in the bottom and a hole poked in the side wall on the 3rd load..
Gavilon Grain in Catoosa..
Fortunately since the trailer was new it was easy to show that they were the only outfit that could have done the damage..
Otherwise it would have been impossible to prove.
