CDL DRIVERS HAVE NO CONSTITUTIONAL RIGHTS.

WHAT THE F&*(...? This is what some drivers are hearing from the Police ...A friend of mine in Nevada..I was told this in California...and where else?...This is how far we have come in the eyes of the Police..In other words according to some..we have less rights than some illegal alien...The question is..just how far does one want to push this? It is turning from I want to inspect the cab of your truck to I am going to inspect it...Again as my other post..When is this going to stop? Have we gone this far to lose all respect?

How far can an officer go? What is illegal search and seizure? Can an officer without asking remove or take documents from you that aren't in plain sight? Why are we now supposed to incriminate ourselves? I was asked a question of an officer on friday. It wasn't the truth and he has documents to prove it. But am I or any of us going to just sit in that seat and just tell an officer incriminating information? If you pull into a scale and an officer asks if you exceeded the speed limit are you now supposed to tell him so that he can right you a citation without having to actually catch you? Where is the line? Do we all understand the cost of defense and are willing to fight these situations or has the industry gotten to a point where we are all going to work and live by the letter of the law? How many of will be able to continue with the new CSA point program? You have no way to get rid of points once accrued. This officer stated that if he had a driver that received an infraction of any type that then resulted in CSA points that driver should be fired. With this line of thought how long will there be drivers for this part of the driving industry or cow hauling or anything requiring thinking out of the box. What about loyalty for an employee that stays with you when things are hard? Now if he makes a mistake that I might also make I should fire him?

It used to be Peace officer...Then it was Law enforcement officer...Now according to the California Highway Patrol...It is now Para military officer....This has totally gotten out of hand and needs to be stopped.. And now it looks like some of them want the truck driver gone...They will write tickets for anything to Point us out...They haven't figured it out that WE are the ones that put the food on their table...or the gas in their car...or the clothes on their back....or the patrol car that they are driving....It all boils down to the thinking of this bumper sticker I saw once...We don't need farmers...I buy my food at the store...That pretty well says it all for these buffon idiots that just happen to pass a test and the polygraph ..and are give a star so mommy can pin on their chest..Mom doesn't want junior to prick themselves...I was told once that if a revolution starts in this country...It will be started by truck drivers....It is starting to look more and more like a true statement.. When you used to get a ticket..it was the price of doing business....Now we need to fight every ticket that we get...And if you win...Take off another day and SUE the son- of-a -bitch...They want to play games...As the guy said..."LETS GET READY TO RUMMMMBLE!!!"

Just more proof that this union of states has turned into a Federal Democracy. And then in return the use police powers to push and aggrevate us to fear them! Well. I will not consent to this tyranny nor abide by it.... LET THE SECOND DECLARATION OF INDEPENDENCE BEGIN!!!!

While reading another thread I see that I might be responding in the correct manner as I'm not sure wha the difference is between a reply and a reply with quote, so I hope that no one is offended by lack of skills.

The officer that stopped me told me that anyone with less than a satisfactory rating in Az will be taken out of this business. Further he stated that in 3 years ALL trucks will have eobrs. He then told me that as an owner I should fire any driver that gets written up for ANY infraction that would have an effect on my CSA score including myself. He told me that there was no room in this industry for someone like myself that refuses to abide by and embrace of the new rules.

I have a driver with some violations that he is trying to fight. There are many posts and threads on this site and others where drivers are unhappy do to the fact they feel they are nothing more than a tool. This driver of mine is someone that I have known for over 15 years. I trust him and enjoy working with him. He is loyal to me and my family. What kind of a person much less an employer am I if I dismiss him when he makes a mistake? I am an owner and a driver and make mistakes also. These officers make out like they have never made a mistake ever. As owners why are we not standing up to the Insurance companies and DOT and standing by the people that work beside us? My Insurance company tried to make me abandone my own son after an accident where we went to court and all charges were dismissed completely. I can't enjoy this business if I have to give up my personal values. I have been in this business since '75, I would like to stay and give something to my son, but with DOT/CSA I'm not sure.

Art, I think you have most of it right. It is not about getting rid of all truck drivers, as comment previously. It is about displacing just SOME truck drivers. I used to be an engineer. I lost my job to a Hindu fellow with an H1B temporary work visa good for about 5 years and renewable. He worked for peanuts and had that most prized of possessions, a non-white skin. His employer gladly offered to pay for an immigration attorney to work on a permanent visa or at least a renewal of the H1B. The renewal was going to happen. The permanent visa was not in the interest of the employer as an H1B is effectively indentured servitude. I dusted off my old chauffeur license and discovered that it was not only not permanent, as marked, but was in fact replaced so I got a CDL. I discovered lots of turbans in the freight business as well as Africans, Haitians and Mexicans. Beginning to see a trend? Now just imagine what you could do with selective enforcement and appointing the "right people" to administer the appeals process for the new program? Think they could selectively put one bunch out of business and leave another alone? If you are white surrender all you own. Go pick fruit so a border jumper can have your job and all your possessions. You will make your government happy and they will leave you in peace. It is in the interest of social justice! I know this is something you will support! In case I have not made myself clear, it is about race and the liberal establishments willingness to enforce unwritten policies. If you are White you are the wrong race. You are being sold out by your government! Tom
