What is Fair

We have been at a reciever since Thursday morning. We still have not been unloaded and they say it will probably be late Monday or Tuesday. What would be fair for waiting 5 to 6 days to get unloaded? This is the first time this has happened to us. Have any of you ever had to deal with something like this? Reciever says the silos are full and no where to store the product.

I woulda taken it back to the shipper on Friday. They knew then they weren't gonna unload you. $750/day for lost revenue. Of course they'll tell you to get bent, so give them til Monday noon, then windrow it in the parking lot. Sure you'll have a $1000 cargo claim, but its still cheaper than sitting for a week with some losers crap on your trailer as free storage

Be a little careful about windrowing it in the parking lot. As cool as that may sound there are a lot on complications involving that. First off there is the fact that the company you are hauling for and the reciever will come after you for that. Depending on the product the EPA may get involved for illegal dumping not to mention the cleanup charges. If the epa decides to call in a hazmat abatement team it can run into the thousands of dollars. As glamorous and tempting as it may sound, don't even consider dumping it. You will regret that decision for a long time. Your cargo insurance will probably be invalid because cargo covers only damage to the cargo. Very seldom to they cover a situation like this.

2 hours free then a minimum of 65 per hour until the truck is empty. You are not a storage unit! Call and get it approved in writing before you let them have their product!

Man that stinks. Sure makes you feel worthless. How did you make out? I hope you left or else made 1000 a day to sit there. That would take the patience of Job to sit for 5 days. I get all wadded up,grouchy, heartburn,covid symptoms,diarrhea, nausea after 5 hours.

Sorry, that has happened to you. It happens here on the East Coast all the time. The rate is 25.00 after one hour of delay, however it's not mandatory that the receiver pay detention. It usually depends on the situation, our policy is if the receiver refuses to take the load we tell our drivers to return it to where it was loaded. After five days even Wheat becomes hard to get out of a hopper. Good Luck, what did your Loading Company have to say about it, they can always divert you to another facility to get it off loaded. Hope that helps.

If you are not sure in the future if they can unload you be sure to call the mill before hand to avoid this issue, sometimes plants break down but there is always another mill that can take the product. Whoever loaded you should be able to divert you to another location or recall the load.

25 an hour for wait time? Why not work at sheetz and have a life with zero overhead for 13 an hour. Its time the feds get on this and standardize 90 an hr minimum everywhere. It would force companies to upgrade equipment to unload and load in a timely manner instead of lining their pockets and investors. WAITING TIME = NOT GETTING FINISHED, NOT AT HOME, LESS MONEY, MORE AGGRAVATION.

A side dump moving dirt makes over a hundred a hour on a regular basis, so it’s hard for me to understand why you would put a truck under a hopper for any less.

We have encountered this, however usually brokers will offer detention pay. Might be worth asking about.

We got $2400 in detention. Not great but i guess could have been worse. At least we are out of Orangeburg SC.
