The Iron fist

It turns out that the Iron fist, has become the velvet glove, as the FMCSA appears unable to enforce the ELD mandate, during the first week of hard enforcement. As truckers pass by the scale house's, the back parking lots appear to be empty, despite the fact that thousands of truckers continue to report malfunctions with their ELD. In the mean time, The DOT appears to be playing "let's make a deal", as Mr Martinez continues to hold listening sessions. Perhaps they could turn this into a game show, and trump could make special appearances.

Short amount of time? Hard enforcement started last Sunday, and now it's almost Friday. This went into effect 5 days ago. What rock did you just crawl out from under?

HAD AN INTERESTING "IRON FIST SITUATION" LAST NITE. MY DRIVERS GOT STOPPED OUTSIDE LOUISVILLE KY BY A KENTUCKY STATE TROOPER. HE ASKED TO CHECK THEIR ELD. DRIVER SAID OK. (LIKE IT WOULD DO MUCH GOOD TO REFUSE) THE OFFICER COULD NOT CONNECT WITH THE DRIVER'S ELD AND WHEN THE GUYS PRINTED OUT THE RECORD THE COP TOLD THEM THAT HE DIDN'T THINK THE UNIT WAS FUNCTIONING PROPERLY AND WROTE THEM A WARNING FOR AN IMPROPER LOGGING DEVICE, AND SLAPPED THEM WITH A 10 HOUR BREAK EVEN THOUGH THE PRINTOUT SHOWED 5 HOURS OF SERVICE AVAILABLE. UP TIL THAT INCIDENT WE HAVEN'T HAD ANY QUESTIONABLE EXPERIENCE WITH BEING CHECKED.

There may be a few folks getting checked, but there are also certain carriers with a bad safety score, that the DOT is targeting specifically, not saying that your one of them, but your driver could have been swept up in that operation. I talked with several other drivers this week, each running different parts of the country from the east coast to the west coast, and all reported that the scales appeared normal. Now maybe these particular drivers were just lucky, and passed through at the right time? Ok that's possible, but in the age of youtube and social media, we should be seeing scalehouses jammed full of out of out of service trucks, given that there are thousands of defective ELD's out there. So why don't we?

ANYTHING IS POSSIBLE. I DO KNOW THIS PARTICULAR CARRIER HAS A PRETTY DECENT CSA SCORE. I AM THINKING IT WAS MORE OF A CASE OF AN OFFICER HEADING IN FOR SHIFT CHANGE AND CHANCES ARE IT WAS A RANDOM STOP. I WAS INTRIGUED BY THE WARNING. COULD IT BE POSSIBLE THAT THE OFFICERS CONNECTION WASN'T GOOD DUE TO WHERE WE WERE IN KY. CELL SERVICE CAN BE SPOTTY THERE AT BEST. KNOWING HOW I REACT WHEN MY COMPUTER OR CELL PHONE DOESN'T CONNECT WELL WITH WHAT I WANT THEM TO DO, I GUESSED IT TO BE A SIMILAR SITUATION. WHO KNOWS.

Duane since you bring up spotty cell phone coverage, I have to wonder what effect a stingray unit would have on a ELD, since they work by tricking a cell phone into seeing a tower that isn't there, by sending out a stronger signal. Every law enforcement agency is using them, and if there was one in close proximity to a scalehouse?

sounds like an embarrassed trooper to me. just because he can't get his connection to work, does not mean the driver or company should get a warning and put out of service. It will probably effect CSA scores

COULDN'T SAY SINCE I DON'T HAVE ANY PERSONAL EXPERIENCE WITH THOSE UNITS. IT'S POSSIBLE SOMETHING LIKE THAT MAY WORK. DRIVER TOLD ME THEY WERE AT THE BOTTOM OF A HILL WHEN THEY GOT PULLED OVER SO WHO KNOWS. IT WILL BE INTERESTING TO SEE IF THE "IMPROPER LOGGING DEVICE" WARNING HAS ANY EFFECT ON HIS CSA SCORE. ONE OF MY GUYS GOT STOPPED IN MONTANA THIS MORNING AND THE OFFICER COULD NOT GET A CONNECTION OUT IN THE BACKWOODS THERE EITHER. THAT DRIVER GAVE THE OFFICER A PRINTOUT OF HIS ELD AND THE OFFICER TOLD HIM TO HAVE A NICE DAY. DOESN'T SEEM TO BE MUCH DIFFERENCE IN ENFORCEMENT THAT WITH PAPER LOGS. OFFICER'S DISCRETION AS TO HOW TO HANDLE IT. THEY CAN BE DECENT TO GET ALONG WITH OR THEY CAN BE "YOU IN A HEAP OF TROUBLE BOY" TO GET ALONG WITH. THAT WILL NEVER CHANGE.

Now the megga brokers/carriers seem to be upset that I am pointing out the obvious, as I received so many dislikes for pointing out the obvious, yet none of them can disprove what's been said. Where is the coverage of hard enforcement? Where are the youtube video's, and news coverage showing all of these truckers with defective ELD's, being placed out of service at the scales? Or coverage on spacebook? We could cover operation black and blue, Or all of those D.C protests, or the LA freeway being shut down, but on the Hard enforcement what do we see? Nothing, becuase you can't show what's not there. If they were doing what they said they would, it would shut the supply chain down, and the gooberment would have to explain how the ATA made a fool out of them. Then bye bye mandate, and consolidation of power.

Did the drivers have the correct documentation to show the KSP that the protocol for viewing the ELD is visual, electronic or printed? FMCSA has published the revised guidelines for this. KSP would not have been able to do anything then. Contact Andrea Marks she is battling the unjustified tickets for us. Let me know if u need any further info

ANY warning you receive automatically goes against your CSA score. Trooper's attempt to tell you that it doesn't but it does. There is nothing you can do about it except sue the state and spend millions of dollars and still change nothing.
