Workman comp. coming back to broker?

Struggling with an audit that came back saying all owner/operators who I hired last year fall under my workman comp policy for 2 employees.
Last year my policy was $400 again for 2 employess now I am being told I need to pay $17,000 for last year. They are virtually saying that they were all employees of mine?
Anyone ever heeard of such a thing?

It should be in your carrier contract that the carrier is responsible for WC insurance. There too, you’re hiring them as a subcontractor. Sounds like someone doesn’t know what he’s doing over by your insurance agent.

Yes we did. It really is crazy I can understand going forward saying my policy rate is going up but the way it is if I quote you $5 grand to paint your house and I get done and say " That job was bigger than I thought I am going to need $10 K.

You need to argue your point. They tried the same here. We showed our broker/carrier contract requiring our carriers to have their own WC policies. We then provided copies of dozens of current COI's showing WC coverage for a sampling of our 1099 carriers. They reversed their audit decision and returned the policy to the pre-audit number. DO NOT PAY THAT PREMIUM!

You have to the owner op buy a $1000 policy on them selfs all done .

I went through this work comp audit even though I did 1099s for my drivers or operator's I should say anyway yeah they want me to pay in on 135 so I had to show proof that it was their truck I get copies of titles registrations driver's license send it all in and then it dropped it then I just paid in the usual the two high price of working which is BS I'd rather not have it it is a pile of crap. I actually did explain it to them and they told me to get on their web site and file a complaint and they will look into it...

Check with your local state law. In TN there is a law stating that contract labor does not have to be covered under our policy. I just beat a aduit demand of 20,000.00. I used state law and lease contract. I got a 127.00 refund after everything was said and done. Good luck

I have trucker agreementsin place...
This is 100% fight against the workman comp. policy that I had for myself and their token that it needs to umbrella coverage every owner operator that I hired.
Now they want to audit Jan.1 thru April 20.....I knew it.

I had to show that everyone on their own truck 1099 registrations tax forms and then they left me alone it's just took some time of An Inconvenient for my office gal for 2 months so I sent them a bill for the time involved and received nothing. Workman's comp is a fraud my opinion
